Agreement to Terms

By accessing or using Pulsewatch.io, you agree to be bound by these Terms & Conditions. If you disagree with any part of these terms, you may not use our services.

Service Description

Pulsewatch.io is an uptime monitoring platform that provides:

  • HTTP/HTTPS endpoint monitoring
  • TCP port and ping checks
  • DNS record monitoring
  • SSL certificate validation and expiry tracking
  • Real-time alerts through 50+ notification channels
  • Historical uptime data and performance analytics
  • Public and private status pages
  • API access for programmatic monitoring
  • Team collaboration tools
  • Incident management and reporting

We reserve the right to modify, suspend, or discontinue any feature at any time with reasonable notice.

Account Registration and Use

Eligibility

To use Pulsewatch.io, you must:

  • Be at least 18 years of age
  • Provide accurate and complete registration information
  • Have authority to bind your organization (for team accounts)
  • Comply with all applicable laws and regulations

Account Security

You are responsible for:

  • Maintaining the confidentiality of your credentials
  • All activities that occur under your account
  • Notifying us immediately of any security breaches
  • Using strong passwords and enabling two-factor authentication (when available)

We are not liable for unauthorized access resulting from your failure to secure your account.

Account Types

  • Individual Accounts — For personal use and small projects
  • Team Accounts — For collaborative monitoring with multiple users
  • Enterprise Accounts — For organizations requiring advanced features and SLAs

Subscription Plans and Pricing

Startup Plan (Free)

  • 10 monitors
  • 60-second check intervals
  • Email notifications only
  • 30-day data retention
  • Public status pages
  • Community support

Professional Plan ($29/month)

  • 50 monitors
  • 30-second check intervals
  • All notification channels (Slack, Discord, Telegram, webhooks, email, SMS)
  • 1-year data retention
  • Custom status pages with branding
  • API access
  • Team collaboration features
  • Email support

Enterprise Plan (Custom Pricing)

  • Unlimited monitors
  • 10-second check intervals (or faster upon request)
  • Priority 24/7 support
  • Unlimited data retention
  • White-label status pages
  • SSO/SAML authentication
  • Custom SLA guarantees
  • Dedicated account manager
  • On-premise deployment options (upon request)

Billing Terms

  • Subscription fees are billed monthly or annually in advance
  • All fees are in USD unless otherwise specified
  • Payment is due immediately upon invoice
  • Failed payments may result in service suspension
  • No refunds for partial months or unused services
  • Annual plans are non-refundable but can be cancelled before renewal

Price Changes

We reserve the right to change our pricing with 30 days’ notice. Current subscribers will maintain their pricing for the remainder of their billing cycle.

Free Trial

New users may be eligible for a free trial period. Credit card information may be required. If you don’t cancel before the trial ends, you’ll be automatically charged for the selected plan.

Acceptable Use Policy

You agree NOT to use Pulsewatch.io to:

  • Monitor services you don’t own or have permission to monitor
  • Conduct denial-of-service attacks or excessive requests
  • Monitor illegal content or services
  • Circumvent security measures or access controls
  • Resell or redistribute our services without authorization
  • Use our service to spam or send unsolicited communications
  • Monitor websites that violate laws or third-party rights
  • Attempt to reverse engineer our platform
  • Share account credentials with unauthorized users
  • Exceed rate limits or abuse our infrastructure

Rate Limits and Fair Use

  • Monitoring intervals must respect your plan limits
  • API requests are limited based on your subscription
  • Excessive use that impacts service performance is prohibited
  • We reserve the right to throttle or suspend accounts that abuse resources

Violation of this policy may result in immediate account suspension or termination without refund.

Monitoring Accuracy and Limitations

Service Availability

While we strive for maximum uptime, Pulsewatch.io is provided “as is” without guarantees of:

  • 100% uptime or error-free operation
  • Absolute accuracy of monitoring data
  • Immediate alert delivery in all circumstances
  • Compatibility with all endpoints or services

SLA for Enterprise Plans

Enterprise customers receive SLA guarantees as specified in their contracts. Standard plans do not include SLA guarantees.

Monitoring Limitations

  • Check intervals are “best effort” and may vary based on network conditions
  • Alerts may be delayed due to external factors (email delivery, third-party APIs)
  • We are not responsible for false positives or missed downtime events
  • Historical data accuracy depends on successful check completions

Maintenance Windows

We perform scheduled maintenance with advance notice. During maintenance:

  • Monitoring checks may be temporarily paused
  • Dashboard access may be limited
  • Alerts may be delayed
  • No SLA credits apply for scheduled maintenance

Data and Privacy

Your Monitoring Data

You retain ownership of:

  • URLs and endpoints you monitor
  • Custom configurations and alert rules
  • Historical uptime data
  • Status page content

We have a license to process this data solely to provide our services.

Data Backup

We maintain regular backups of your data. However:

  • We are not responsible for data loss due to your actions
  • Backups are for disaster recovery, not data retrieval
  • Deleted data may not be recoverable after 30 days

Data Export

You can export your monitoring data at any time through:

  • CSV exports from the dashboard
  • API access to historical data
  • Status page export tools

Public Status Pages

Visibility

Public status pages are accessible to anyone with the URL. You control:

  • Which monitors appear on status pages
  • Historical data visibility
  • Incident details and updates
  • Custom branding and domains

Responsibility

You are responsible for:

  • Content accuracy on status pages
  • Compliance with applicable laws
  • Not displaying confidential or sensitive information
  • Maintaining appropriate incident communications

We are not liable for information you choose to make public.

API Access and Integration

API Terms

  • API access is provided according to your subscription plan
  • API keys are your responsibility to secure
  • Rate limits apply based on your plan
  • API usage must comply with these terms

API Rate Limits

  • Professional Plan — 10,000 requests/hour
  • Enterprise Plan — Custom limits as agreed

Exceeding rate limits may result in temporary API suspension.

Third-Party Integrations

Integrations with external services (Slack, Discord, etc.) are subject to:

  • Those services’ terms and conditions
  • Availability and functionality of third-party APIs
  • Your proper configuration and authorization

We are not responsible for issues caused by third-party services.

Intellectual Property

Our Rights

All content, features, and functionality of Pulsewatch.io, including:

  • Software code and algorithms
  • Monitoring logic and infrastructure
  • Dashboard design and user interface
  • Logos, trademarks, and branding
  • Documentation and support materials

…are owned by Pulsewatch.io and protected by intellectual property laws.

License Grant

We grant you a limited, non-exclusive, non-transferable license to use Pulsewatch.io for monitoring services according to your subscription plan.

Restrictions

You may not:

  • Copy, modify, or create derivative works
  • Reverse engineer or decompile our software
  • Remove proprietary notices or labels
  • Use our trademarks without permission

Warranties and Disclaimers

Service Disclaimer

PULSEWATCH.IO IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE
  • ACCURACY OR RELIABILITY OF MONITORING DATA
  • UNINTERRUPTED OR ERROR-FREE OPERATION
  • SECURITY OF DATA TRANSMISSION
  • COMPATIBILITY WITH YOUR SYSTEMS

Monitoring Disclaimer

We cannot guarantee:

  • Detection of all downtime events
  • Immediate alert delivery
  • Accuracy of response time measurements
  • Prevention of service outages

YOU ACKNOWLEDGE THAT UPTIME MONITORING IS NOT A SUBSTITUTE FOR PROPER SYSTEM ADMINISTRATION, BACKUP STRATEGIES, OR INCIDENT RESPONSE PLANNING.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

Liability Cap

Our total liability for any claims arising from your use of Pulsewatch.io shall not exceed the amount you paid us in the 12 months preceding the claim.

Excluded Damages

We are NOT liable for:

  • Indirect, incidental, or consequential damages
  • Lost profits, revenue, or business opportunities
  • Data loss or corruption
  • Service interruptions or downtime
  • Costs of substitute services
  • Third-party claims
  • Monitoring data inaccuracies

No Liability for Downtime

We are not liable for:

  • Downtime of your monitored services
  • Financial losses from undetected outages
  • Missed SLA obligations to your customers
  • Reputational damage from service issues

Some jurisdictions don’t allow limitation of certain warranties or liabilities, so these limitations may not fully apply to you.

Indemnification

You agree to indemnify and hold harmless Pulsewatch.io, its officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of our services
  • Violation of these terms
  • Infringement of third-party rights
  • Your monitored endpoints or services
  • Content on your public status pages
  • Misuse of our API or integrations

Termination

By You

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period.

By Us

We may suspend or terminate your account if you:

  • Breach these terms
  • Engage in fraudulent activity or payment disputes
  • Abuse our infrastructure or resources
  • Fail to pay required fees
  • Use our service for illegal purposes

Effect of Termination

Upon termination:

  • Monitoring checks stop immediately
  • Access to dashboard and API is revoked
  • Data is retained per our Privacy Policy (typically 30 days)
  • Outstanding fees remain due and payable
  • No refunds for prepaid services

Changes to Terms

We may modify these terms at any time. For material changes:

  • We’ll update the “Last Updated” date
  • We’ll notify users via email
  • We’ll post a notice on the dashboard

Continued use after changes constitutes acceptance. If you disagree with changes, cancel your subscription before they take effect.

Governing Law and Disputes

These terms are governed by the laws of the United States, without regard to conflict of law principles.

Dispute Resolution

For disputes:

  1. Contact us at legal@pulsewatch.io to attempt informal resolution
  2. If unresolved within 30 days, disputes will be settled through binding arbitration
  3. Arbitration will be conducted under applicable arbitration rules
  4. Each party bears its own costs unless otherwise awarded

Class Action Waiver

You agree to resolve disputes individually, not as part of a class action or collective proceeding.

Exceptions

Either party may seek injunctive relief in court for:

  • Intellectual property infringement
  • Breach of confidentiality
  • Violation of acceptable use policy

General Provisions

Entire Agreement

These terms, together with our Privacy Policy, constitute the entire agreement between you and Pulsewatch.io.

Severability

If any provision is unenforceable, the remaining provisions remain in effect.

No Waiver

Our failure to enforce any provision doesn’t constitute a waiver of that right.

Assignment

You may not assign these terms without our written consent. We may assign these terms freely.

Force Majeure

We’re not liable for failures caused by circumstances beyond our reasonable control, including:

  • Natural disasters
  • Internet service provider failures
  • Cloud infrastructure outages
  • Government actions or regulations
